This Privacy Policy ("Policy") describes how we at Mint Gøld Dust collect, use, share, and secure your Personal Information when you visit the Mint Gøld Dust Platform (https://www.mintgolddust.com) (the "Platform") or create, buy, transfer, or trade unique Mint Gøld Dust items in our Market (the "Market").

  • Creating a User Account : If you sign up to use Platform, we collect your Ethereum wallet address and username. You may elect to provide your email address, biographical information, and a website url or social links.
    • In particular, MetaMask and other wallets provide us with your Ethereum address and certain other information you choose to share with MetaMask and other wallets. These third party companies may supply us with Personal Information. We may add this to the information we have already collected from you via our Platform in order to improve it. We do not collect Personal Information automatically, but we may tie the information that we collect automatically to Personal Information about you that we collect from other sources or that you provide to us.
  • Applying as an Artist : If you want to join the world's top digital artists in our Market, we collect your first and last name, email address, a short application video, Ethereum wallet address, and information about your art in a separate Artist application on the Platform.
    • We hold the right to assess all Artist applications and approve applications at our sole discretion. Once your Artist application is approved, we will create your Artist account with an Artist description based on information from your application.
    • As part of your Artist account, we may display widgets that direct to your third party social media accounts that you provide as part of your application.
  • Visiting the Platform or Market : We collect analytics data when you access or use the Platform. We may use third party consent management services (such as Segment, Data Privacy Manager, and CookiePro) to collect and record your customized tracking preferences, such as entirely opting out of non-essential tracking or selectively opting out of categories of information processing tools.
    • We continuously monitor user activity on the Platform to ensure adherence to laws, regulations, and our Terms of Use. As such, we may collect information from you, including your Internet Protocol (&quout;IP") address. We may also collect your browser type, operating system, domain name, and interactions on the Platform.
    • We use third party service providers (such as Sentry, Segment, Google Analytics, and Heap) to manage and analyze user activity on the Platform so that we can better tailor the Platform to your needs. Such service providers may collect IP addresses, browser type, Internet service provider ("ISP"), referring/exit pages, operating system, date/time stamp, clickstream data, and user profile information (if you are logged in). The service providers may store and use this data to make graphs to help us understand user behavior on the Platform.

    • We also may use tracking pixels (also referred to as clear GIFs, web beacons, or web bugs). Tracking pixels are tiny graphic images with a unique identifier, similar in function to Cookies, that are used to track online movements of web users. In contrast to Cookies, which are stored on a user's computer hard drive, tracking pixels are embedded invisibly in webpages.
  • Corresponding with Us : We may collect records copies of your correspondence if you contact us, as well as your responses to surveys that we might ask you to complete for research purposes.
  • Live Chatting : We use the third party live chat provider Intercom to connect with you in real time. We may collect records and copies of any live chats in which you engage with us.

California Privacy Rights

  • Third-party marketing: We do not provide your information to third parties for their direct marketing purposes. However, we may share aggregate or other information that no longer personally identifies you with other parties for our business purposes, marketing, analytics, or other uses.
  • Do not track: Some web browsers or smartphones set "Do Not Track" requests to block user activity from being tracked across web pages or devices. We do not honor Do Not Track mechanism as there is no industry-standard way to do so.

Minors and Children

The Platform is not intended for use by children under the age of 18, and we do not knowingly collect Personal Information from children under the age of 16. If we learn we collected Personal Information from a child under 16 we will delete that information from our files.

Third-Party Links and Services

Our Policy only applies to our Platform and does not apply to third-party websites or services because we do not control those third parties. We are not responsible for the privacy practices or content of third-party websites. We encourage you to review the privacy policies of those third-party sites to learn about their practices or what rights you may have. For conducting cryptocurrency transactions we use third-party electronic wallet extensions such as (but not limited to) MetaMask; your interactions with MetaMask and/or any third-party electronic wallet extensions are governed by the applicable privacy policies. The Digital Millennium Copyright Act

The Digital Millennium Copyright Act (DMCA) sets forth a Notification and Counter Notification process initiated by a party complaining of alleged copyright infringement on the Mint Gøld Dust Platform. We may share information of the notifying party, counter-notifying party, and any involved third parties, such as a Collector, of an allegedly infringing artwork to facilitate communication between the relevant parties for the purposes of complying with or resolving a DMCA dispute or allegation of copyright infringement.

Important Limitations

Nothing in this Policy restricts our ability to:

  • Comply with applicable law, rules, or regulations, including the DMCA;
  • Comply with a civil, criminal, or regulatory inquiry, investigation, subpoena, or lawful court order;
  • Cooperate with law enforcement agencies about conduct we reasonably and in good faith believe may violate the law;
  • Protect our rights or our property;
  • Enforce our Terms of Use; or,
  • Prevent behavior that is (or that we think may be) illegal or unethical.

Data Security

All information you provide to us, with the exception of information stored on the Ethereum blockchain, is stored on our secure servers behind firewalls.

Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your Personal Information, we cannot guarantee the security of your Personal Information transmitted to the Platform. Any transmission of Personal Information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Platform.

We may retain your Personal Information as long as you continue to use the Platform, have an account with us, or for as long as is necessary to fulfill the purposes outlined in this Privacy Policy. You can ask to close your account by contacting us as described above, and we will delete your Personal Information on request. We may, however, retain Personal Information for an additional period as is permitted or required under applicable laws, for legal, tax, or regulatory reasons, or for legitimate and lawful business purposes.
